(1) The following General Terms and Conditions apply to all contracts concluded with VDL Aviation Sp. z o.o., ul. Postępu 12, lok. B, 02-676 Warszawa, Poland (KRS: 0000985925), hereinafter referred to as "VDL Aviation", in connection with the training services offered on this website.
(2) The customer may be either a consumer (a natural person acting outside their professional capacity) or a business client (a legal or natural person acting within their professional capacity).
(3) VDL Aviation reserves the right to amend these Terms and Conditions where necessary to reflect changes in law or technical conditions. Customers will be notified of any changes. If the customer does not object in writing within six weeks of notification, the changes shall be deemed accepted.
(1) The presentation of courses and services on this website does not constitute a binding offer, but an invitation to the customer to submit an enquiry or booking request.
(2) By submitting the contact form on this website, the customer makes a binding offer to enter into a training contract. The customer confirms that they are legally capable of entering into contracts and meet all personal prerequisites for training.
(3) VDL Aviation is not obliged to accept every offer. A contract is only formed upon written confirmation by VDL Aviation (by email). VDL Aviation shall confirm or decline the offer within seven days of receipt.
(1) VDL Aviation undertakes to provide training to the student with the goal of achieving the competencies stated in the relevant course description on this website.
(2) The training takes place in accordance with the applicable EASA regulations and the relevant training rules and course syllabi, which form part of the contract.
(3) VDL Aviation does not guarantee that the student will pass any governmental exam or skill test.
(4) VDL Aviation reserves the right to engage qualified third parties (instructors, simulator operators) to deliver training. All such parties operate under VDL Aviation's responsibility.
(1) The student agrees to follow all instructions given during training and to comply with all applicable training regulations.
(2) The student agrees to attend all scheduled training sessions punctually.
(3) If the student is unable to attend a scheduled session, they must inform VDL Aviation as soon as possible and — where required — provide supporting evidence (e.g. medical certificate). Whether evidence is accepted is at VDL Aviation's sole discretion.
(4) The student agrees to prepare for and review lessons in their own time and to supplement training with independent study.
(5) The student must meet all stated entry requirements for the course before training begins. VDL Aviation may terminate the contract without refund if undisclosed ineligibility is discovered after the course starts.
(1) The student is obliged to pay the agreed training fee by the due date.
(2) Payment must be received in full before the start of training, by bank transfer to VDL Aviation's account or in cash. Bank details will be provided in the booking confirmation email.
(3) All listed prices are final prices including any applicable VAT.
(4) Costs of accommodation and travel to and from the training location are not included in the training fee unless explicitly stated otherwise in the course description.
(5) Invoices are issued electronically and sent by email. Delivery is deemed to have taken place upon sending.
(6) In the event of late payment, VDL Aviation reserves the right to charge statutory interest and to suspend or cancel the training until payment is received.
(1) Cancellation by the student: The student may withdraw from the contract free of charge up to 14 days before the start of training by written notice to VDL Aviation (email is sufficient).
(2) If the student cancels within 14 days before the start of training, VDL Aviation will charge a cancellation fee of €250 to cover administration and reservation costs already incurred.
(3) If the student cancels within 48 hours before the start of training, or fails to appear without prior notice (no-show), the full course fee is forfeited. No refund will be issued.
(4) If the student can demonstrate that the cancellation was due to circumstances entirely beyond their control (e.g. hospitalisation), VDL Aviation will consider rescheduling at no extra cost. Such cases are assessed at VDL Aviation's sole discretion.
(5) Cancellation by VDL Aviation: VDL Aviation reserves the right to cancel or reschedule a training session due to operational reasons (e.g. simulator unavailability, instructor illness). In such cases the student will be offered an alternative date or a full refund.
(6) VDL Aviation may terminate the contract with immediate effect for good cause, including but not limited to: established unsuitability of the student as determined by the training director; serious breach of contract or training regulations; damage to training equipment caused by the student; or failure to pay by the due date.
If you are a consumer (as defined in § 1(2)), you have a statutory right to withdraw from this contract within 14 days of conclusion of the contract without giving any reason.

Please note: if you have requested that training begin within the 14-day withdrawal period, you may be charged proportionally for the portion of services already delivered.
(1) VDL Aviation is fully liable for damages caused intentionally or through gross negligence.
(2) In cases of minor negligence, VDL Aviation is liable for loss of life, personal injury, or damage to health without limitation. For other damages, VDL Aviation is only liable where a material contractual obligation (cardinal obligation) has been breached, and such liability is limited to foreseeable and typical damage.
(3) VDL Aviation accepts no liability for equipment or personal property brought to the training facility by the student, unless damage was caused by VDL Aviation's wilful misconduct or gross negligence.
(1) VDL Aviation is relieved of its obligation to perform where and for as long as performance is prevented by circumstances beyond its reasonable control arising after the contract was concluded, including but not limited to: wars, strikes, natural disasters, pandemics, government-imposed restrictions, or technical failures of the simulator not attributable to VDL Aviation.
(2) Each party shall inform the other without delay upon the occurrence of a force majeure event. VDL Aviation will offer alternative dates or, where performance is permanently impossible, a proportional refund.
The processing of personal data in connection with training contracts is governed by VDL Aviation's Privacy Policy, which forms part of these Terms and Conditions.
(1) Any amendments or additions to these Terms and Conditions must be made in writing to be valid.
(2) Should any provision of these Terms and Conditions be or become invalid, the remaining provisions shall not be affected. The invalid provision shall be replaced by a legally valid provision that most closely reflects the economic intent of the original.
(3) These Terms and Conditions are governed by the law of the Republic of Poland. For consumers, this applies only to the extent it does not deprive them of protections afforded by the mandatory law of their country of habitual residence.
(4) For disputes with business clients, the exclusive place of jurisdiction is Warsaw, Poland. For consumers, the applicable statutory rules on jurisdiction apply.
